Kaksi työtodistustyyppiä

Työtodistustyyppejä tunnetaan kaksi. Niin sanottuun laajaan työtodistukseen kirjataan työsuhteen keston ja työtehtävien lisäksi arvio työntekijän suoriutumisesta työtehtävissään ja syy työsuhteen päättymiselle taikka työntekijän valinnan mukaan pelkästään jompikumpi jäljempänä mainituista. Vaihtoehto on ns. suppea työtodistus, jossa on ainoastaan tieto työsuhteen kestosta ja kuvaus työntekijän suorittamista työtehtävistä.

Työntekijä saa määrätä, kumman tyyppisen työtodistuksen haluaa. Hän voi myös ensin pyytää ainoastaan suppean työtodistuksen, mutta laajentaa pyyntönsä myöhemmin laajaan työtodistukseen. Työnantaja on velvollinen antamaan myös uuden työtodistuksen, jos edellinen on esimerkiksi kadonnut.

Mitä tietoja voin kirjata Sopimuskoneen laajaan työtodistukseen?

Laajan työtodistuksen mallimme sisältää kaikki lain edellyttämät tiedot, eli työtehtävien kuvauksen ja työsuhteen keston lisäksi arvion työsuorituksesta ja työsuhteen päättymisen syyn. Muuta työtodistus ei lähtökohtaisesti saa edes sisältää.

Työtodistukset on tapana allekirjoittaa. Halutessasi voit allekirjoittaa todistuksen Sopimuskoneen sähköisellä allekirjoituksella ja lähettää todistuksen suoraan esimerkiksi vastaanottajan sähköpostiin, jolloin tulostaminen ja postittaminen eivät ole tarpeen.

Certificate of Employment, Comprehensive

An employee is entitled to a certificate of employment

The employer is obligated to provide the employee with a written certificate of employment at the end of the employment relationship if requested by the employee. A certificate of employment must be given if requested within 10 years of the end of the employment relationship, and even after that if certain conditions are met. The employer is also required to replace a lost certificate of employment with the same conditions.

An employer violating its obligations related to the certificate of employment shall be sentenced to a fine.

Comprehensive or concise certificate of employment?

There are two types of employment certificates. In addition to the duration of the employment relationship and the employee’s duties, a comprehensive certificate of employment includes an assessment of the employee’s performance and reason for the termination of the employment relationship or, at the employee’s discretion, only one of the latter two. The alternative is a concise certificate of employment, which only indicates the duration of the employment relationship and a description of the duties performed by the employee.

The employee may decide the extent of their certificate of employment

It is up to the employee to decide whether the certificate of employment is issued in a comprehensive or concise form. A concise certificate is issued if the employee does not request otherwise. So please make sure that you are not writing a comprehensive certificate of employment unnecessarily if the employee does not want one. On the other hand, the employee has the right to obtain a comprehensive certificate of employment at a later date, even if they initially asked for a concise version.

How can the employee be assessed?

The assessment should cover the employee’s occupational skills, diligence and conduct. It is not appropriate to go beyond these and discuss matters such as the employee’s personal life. Being objective is permitted. An employee who has requested a comprehensive certificate but is not satisfied with the assessment is not entitled to a new certificate of their liking.
