Kattava vuokrasopimus takaa yksilölliset tarpeesi

Liikehuoneiston vuokrasopimuksesta on lain mukaan kyse silloin, kun huoneisto vuokrataan mihin tahansa muuhun kuin asumiskäyttöön. Jos vuokraat tilat siis esimerkiksi toimisto- tai myymäläkäyttöön, puhutaan liikehuoneiston vuokrasopimuksesta. Sopimuksen otsikoinnilla ei ole tässä suhteessa merkitystä – se voi olla toimiston vuokrasopimus, myymälän vuokrasopimus tai liiketilan vuokrasopimus.

Liikehuoneistojen vuokrasopimuksissa sopimusvapaus on laajempi kuin asuinhuoneiston vuokrasopimuksissa – esimerkiksi irtisanomisajoista saadaan sopia vapaasti. Siihen, mistä ei ole erikseen osapuolten välillä sovittu, sovelletaan liikehuoneiston vuokrauksesta annettua lakia. Yksilöllisten tarpeittesi huomioimiseksi erillinen kirjallinen sopimus on suositeltava.

Vuokrasopimuksissa sovitaan vuokrakohteen ja vuokran suuruuden lisäksi tyypillisesti esimerkiksi vuokravakuudesta, vuokran tarkistamisesta, avaimista sekä tupakoinnin ja alivuokraamisen sallittavuudesta.

What is the lease agreement for business premises?

A lease agreement for business premises is needed when premises are leased for non-residential use. If you lease premises for use as an office or shop, for example, the question is of a lease agreement for business premises. Condition of the premises

In what condition should the premises to be leased be, as a rule?

At the beginning of the lease, the premises must be in a condition that the tenant can reasonably expect in view of the age of the building, the condition of other premises used for a corresponding purpose in the area and other local conditions. However, the parties may agree to derogate from this point of departure.

How must a tenant look after the premises?

The tenant must look after the premises with all due care. The tenant shall not, however, be ordinary wear and tear caused by use of the premises for the purpose specified in the lease agreement, provided that the lessor is responsible for the premises’ upkeep and maintenance.

Should the condition of the premises be somehow explained in the lease agreement?

Lease agreements often take a stand on the condition in which the premises are leased. It may be wise for both the lessor and the tenant. On the one hand, the lessor protects itself against claims suggesting that the premises are not in the condition that the tenant could reasonably expect. On the other hand, the tenant may be better protected against claims suggesting that they have looked after the premises with all due care if the premises already had certain faults from the start and the lessor later accuses the tenant of having caused them.

How should the condition of the premises be entered in the agreement?

If there are exceptional deficiencies in the premises, they should be specified in the lease agreement. For example, it is a good idea to mention significant cosmetic defects and poorly working equipment.

The term ”in the condition as it is” is often used, with the aim of exhaustively determining the condition of the premises as it was, for example, in the inspection preceding the conclusion of the lease agreement or in photos taken of the premises. Such a term does not release the lessor from responsibility if the tenant, exercising usual care, could not have discovered or expected a specific deficiency.
