On what grounds can an employment contract be terminated?

Grounds for termination are legally divided into 1) grounds related to the employee’s person and 2) financial and production-related grounds. In both cases, termination is only possible for proper and weighty reasons.

What are the grounds for termination related to the employee’s person?

If the grounds for termination are related to the employee’s person, dismissal requires a serious breach or neglect of the employee’s obligations. A permanent and significant reduction in working capacity due to the employee’s illness can also be grounds for dismissal. As a rule, an employee has to be warned before their employment contract can be terminated due to a breach. In such cases, dismissal is only permitted if the reprehensible conduct is repeated.

When is dismissal on financial and production-related grounds possible?

The employer may terminate the employment contract without issuing a warning if the work to be offered has diminished substantially and permanently for financial or production-related reasons or for reasons arising from reorganisation of the employer's operations. The employee has a duty to seek to transfer the employee or train them for other duties before dismissal.

Must the employee be afforded with an opportunity to be heard before dismissal?

What is the procedure for handling possible employment-related dwellings?
